Dissolving Marriage
Divorce is the legal process that dissolves marriage. Once the decision is made to proceed with divorce most people want to proceed quickly. Cheesman and Company will issue you divorce petition on the same day you instruct us. Most divorces are straightforward and unopposed and can be obtained in 3 to 4 months.
Financial settlement
Divorces involve financial issues. They commonly include:
- Maintenance for one of the spouses and or children (including school fees)
- Payment a lump sum by one spouse to the other
- Transfer of ownership of matrimonial property
- Transfer of pension funds
- Injunctions to preserve assets pending settlement
The sooner agreement can be reached with your spouse in respect of financial matters the better. From our first meeting Cheesman and Company will work towards formulating proposals for settlement so that the heavy cost of court hearings is avoided.
Pre Nuptial Agreements
A Prenuptial Agreement is a formal written agreement entered into by a couple before marriage. It's purpose is to record the parties' intentions as to the division of assets in the event that the marriage breaks down. Courts are increasingly taking account of such agreements.
At Cheesman and Company, we offer a "fixed fee" for preparing your Prenuptial Agreement.
