“A timely injunction can prevent assets being moved to a third party or out of the jurisdiction.”

Injunction to Protect Matrimonial Assets

Courts have wide ranging powers in this regard and such Injunctions are of vital importance and can alter the whole course of proceedings. It is essential that such applications are made immediately, because any delay can be ruinous.

Courts will always act to prevent the disposal or transfer of matrimonial assets by one party when deliberately undertaken in an attempt to defeat the other party’s claim.

Such dispositions are usually carried out in the misguided belief that the asset can in some way be hidden from the court or cleverly transferred to a relative or other third party, or out of the jurisdiction. Such attempts will be quickly thwarted if action is taken to prevent them from happening in the first place.

"A robust and totally unflinching approach."
